This policy governs the strategy, creation, and distribution of email marketing campaigns provided by Brilliantek LLC and its division Brilliantek Media.
- Compliance & Anti-Spam Requirements
To protect our reputation and your domain health, all email marketing must comply with the following:
- Permission-Based Only: We will not send emails to “purchased,” “rented,” or “scraped” lists. The Client warrants that all recipients have explicitly opted-in to receive communications.
- Unsubscribe Compliance: Every email will include a clear, functional “Unsubscribe” link. We will not remove or hide this link.
- Physical Address: The Client must provide a valid physical postal address to be included in the footer of all outgoing emails as required by law.

- Tier Descriptions & Limitations
- Level 1 & 2 (Foundational): These tiers focus on “staying top-of-mind.” We use your existing website content to create a summary email. Advanced “drip sequences” or “abandoned cart” logic are not included.
- Level 3 (Creative): We build custom layouts and graphics for specific promotions or events. Content is sent to the Client for approval [e.g., 3 days] prior to the send date. No response will assume approval and the content will be released.
- Level 4 (Autonomous): We manage the full calendar. To maintain consistency, content is created and deployed without prior client approval.
- The “Retraction” Rule: If a client dislikes an email sent in Level 4 or 5, we will archive the campaign, but no credits or refunds will be issued for the labor already performed.
- Level 5 (Advanced Optimization): Includes everything in Level 4 plus full inbox management. We monitor replies to marketing emails and provide basic assistance/redirection for customer inquiries. If the client does not have an email to manage customer responses, one will be created at the expense of the client, such as, added an email account that may be out of a potential hosting plan (upgrade to hosting plan possible) or creating an emailing account through a third-party such as Google Gmail or Microsoft Outlook.
- Paid Tools & Deliverability
- Platform Fees: The Client is responsible for the monthly subscription cost of the Email Service Provider (ESP) (e.g., Mailchimp, Klaviyo, Constant Contact, Zoho Marketing).
- Level 5 Exclusive Credit: Only Level 5 includes a $100 monthly credit applied toward ESP subscription fees or premium email testing tools (like Litmus). Any cost exceeding $100 is the Client’s responsibility.
- Deliverability: While we follow all “Best Practices” (SPF, DKIM, and DMARC setup), we cannot guarantee 100% inbox placement, as this is subject to the filters of individual providers (Gmail, Outlook, etc.).
- Data & List Management
- List Hygiene: For Tiers 3, 4, and 5, we will perform quarterly “List Cleaning” to remove inactive subscribers, which helps maintain your sender reputation.
- Data Ownership: All subscriber lists remain the exclusive property of the Client. We will never share or sell your list data to third parties.
